Most asked

Someone stole my content. What do I do?

The right next step depends on where your content appears, how it is being used, and what rights you have. A DMCA takedown may be appropriate for content hosted online, while a cease & desist communicates directly with the person or business using your work.

Get Help With Infringement
Can a brand use my content forever just because they paid me?

Not necessarily. The answer may depend heavily on the rights granted in your agreement. A contract could give a company much broader or longer-lasting rights than you expect.

Have Us Review Your Contract
I already have a contract. Can you just review it?

Absolutely. We can review the agreement, identify potential concerns, and provide feedback so you better understand what you are being asked to sign.

Have Us Review Your Contract
What happens after I purchase a service?

You’ll receive a confirmation and a link to complete the intake for your service. Once we have the information we need, our team will review your submission and communicate the next steps.

I have legal questions all the time. Is membership better for me?

It may be. If contracts, content protection, intellectual property, and business legal questions regularly come up in your business, ongoing membership may make more sense than purchasing individual services each time.

Someone reposted my content but gave me credit. Is that allowed?

Giving credit does not automatically give someone permission to use copyrighted work. Whether you can take action depends on the work, how it was used, and the circumstances.

Someone is using my photo, video, design, or other content online. Can you get it removed?

Potentially. We can evaluate the use and determine whether a takedown request, cease & desist, or another enforcement strategy may be appropriate.

Get Help With Infringement
Someone copied my course, ebook, template, or digital product. Can you help?

Yes. We can assess what was copied, the rights you may have in the original work, and potential options for addressing the copying.

Talk to an IP Attorney
What if someone copied my idea but not my exact content?

Copyright generally protects original expression rather than ideas themselves. Depending on what happened, other agreements or legal protections may be relevant.

Talk to an IP Attorney
What’s the difference between a DMCA takedown and a cease & desist?

A DMCA takedown generally asks an online service provider to remove allegedly infringing material. A cease & desist is typically sent directly to a person or business demanding that specified conduct stop.

Explore Enforcement Options
Should I send a DM or a legal letter when someone copies me?

It depends. An informal message may resolve some situations, while others may warrant a more formal approach. Before contacting the other party, consider the value of the work, the extent of the copying, the evidence you have, and your broader enforcement strategy.

Trademarks & Your Brand

Can I trademark my brand name before I launch?

Potentially. Federal trademark applications can sometimes be filed based on a bona fide intent to use a mark in commerce. We can evaluate the name and potential conflicts before determining the appropriate filing strategy.

Protect Your Trademark
Can I trademark my social media handle?

Potentially. A handle may be eligible for trademark protection when it functions as a source identifier, but availability and protectability still need to be evaluated.

Protect Your Trademark
Someone copied my brand name. Is that automatically trademark infringement?

Not necessarily. Trademark infringement involves more than two names being similar. Existing rights, the similarity of the marks, the goods or services involved, and potential consumer confusion may all be relevant.

Talk to an IP Attorney
Can I trademark a name if someone else is already using something similar?

Maybe. Similarity does not automatically mean a mark is unavailable, but existing uses and registrations can create issues. A trademark search can help identify potential conflicts before you invest in filing.

Start a Trademark Search
Someone filed for a trademark similar to mine. What can I do?

Your options can depend on your existing rights and where the other application is in the registration process. Trademark disputes can also involve important deadlines.

Talk to an IP Attorney
I received a trademark Office Action. Does that mean my application was denied?

Not necessarily. An Office Action is a communication from the USPTO identifying legal or procedural issues with an application. Some issues may be addressed through an appropriate response.

Get Help With an Office Action
Do you guarantee that my trademark or copyright will be approved?

No. No law firm can guarantee that a government agency will approve an application or that a particular legal matter will have a specific outcome. We can evaluate potential issues, advise you on your options, and handle the filing or response process.

How long does trademark or copyright registration take?

Processing times vary and can change. Timing may also depend on the application and whether the government raises issues requiring additional responses.

Contracts & Brand Deals

Should I have a contract for brand deals?

A written agreement can help make sure both sides understand payment, content requirements, usage rights, exclusivity, approvals, deadlines, ownership, and other important terms.

I already have a contract. Can you just review it?

Absolutely. We can review the agreement, identify potential concerns, and provide feedback so you better understand what you are being asked to sign.

Can a brand use my content forever just because they paid me?

Not necessarily. The answer may depend heavily on the rights granted in your agreement. A contract could give a company much broader or longer-lasting rights than you expect.

Have Us Review Your Contract
What does “in perpetuity” mean in my contract?

Generally, this language is intended to grant rights that do not expire. The rest of the agreement determines exactly what those rights cover, including where and how your content can be used.

Have Us Review Your Contract
What does “work made for hire” mean?

Work-made-for-hire language can affect who owns the work being created. Ownership provisions can have significant long-term consequences for creators.

Have Us Review Your Contract
Can I negotiate usage rights in a brand deal?

Potentially. Usage period, platforms, paid advertising, exclusivity, territory, ownership, approvals, and compensation can all be subjects of negotiation.

A brand wants to use my content in ads. Should I charge more?

Paid advertising rights can be different from permission to use sponsored content organically. Before agreeing to a price, understand exactly what rights the brand is requesting and for how long.

Licensing & Making Money From Your IP

What if a company wants to license my content?

A written licensing agreement can define what is being licensed, who may use it, where it can be used, for how long, for what purposes, and what you receive in return.

Create a Licensing Agreement
Do I have to sell my content for someone else to use it?

No. Licensing can allow someone to use intellectual property under agreed terms without necessarily transferring ownership.

Can I license the same content to more than one company?

Potentially. It depends on whether the licenses you grant are exclusive or nonexclusive and what restrictions are contained in each agreement.

Talk to an IP Attorney
What happens to my ownership when I license something?

A license does not necessarily transfer ownership. Instead, it can grant specified rights to another party while you retain ownership. The agreement should clearly define those rights.

AI & Digital Content

Do I own content I created with AI?

It depends on how the work was created and the extent of human authorship involved. AI-assisted and AI-generated works can raise different copyright and ownership questions.

Talk to an IP Attorney
Can I use AI-generated images, music, or other content commercially?

That can depend on the tool’s terms, how the material was generated, what it contains, and the rights involved. Commercial use does not automatically mean the content is risk-free.

Talk to an IP Attorney
What if someone uses AI to copy my style or content?

AI can create complicated intellectual property questions, particularly when someone imitates a style without directly reproducing protected expression. We can review the specific use and help you understand what options may be available.

Building Your Business

Do I need an LLC as a creator?

Not every creator needs an LLC immediately. As your revenue, contracts, partnerships, intellectual property, and business obligations grow, forming a separate business entity may become worth considering.

Explore Entity Formation
Should my LLC own my trademarks and copyrights?

That depends on how your business is structured and how you use the intellectual property. Ownership decisions can affect licensing, contracts, future sales, and other business matters.

Talk to an IP Attorney
Do I need to wait until something goes wrong to talk to a lawyer?

No. Many creators and businesses work with attorneys proactively for registrations, contracts, licensing, business structuring, and risk identification.

Working With OwnAura

I only have one legal question. Do I need to hire you for a whole project?

No. You can book a Strategy Call to discuss a specific issue and get direction on potential next steps.

What happens after I purchase a service?

You’ll receive a confirmation and a link to complete the intake for your service. Once we have the information we need, our team will review your submission and communicate the next steps.

What information will you need from me?

It depends on the service. We may ask for information about your business, brand, creative work, contracts, registrations, or dispute. Your intake form will tell you exactly what we need.

How quickly will I hear from someone?

Once your required intake information has been submitted, our team will review it and contact you with next steps according to the timeline provided for your service.

What is included in the flat fee?

Each service page explains what is included in that service. If your matter requires work outside that scope, we’ll discuss the additional work and fees with you before proceeding.

Are government filing fees included?

Government filing fees vary by service. Your service or checkout page will tell you whether government fees are included or charged separately before you purchase.

What if my matter becomes more complicated than the service I purchased?

If your matter requires work outside the scope of the service you purchased, we’ll explain what additional work may be needed and any associated fees before proceeding.

Can I get a refund if I change my mind?

Cancellation and refund eligibility depends on the service purchased and whether work has already begun. Please review the applicable terms before purchasing.

Does purchasing a service automatically make OwnAura my lawyer?

Purchasing a service alone does not necessarily establish an attorney-client relationship. Any attorney-client relationship is governed by the applicable engagement agreement and terms of representation.

Do I still own my intellectual property after hiring OwnAura?

Yes. Hiring OwnAura to advise you or assist with protecting or registering your intellectual property does not, by itself, transfer ownership of that intellectual property to OwnAura.

Can OwnAura represent me anywhere in the United States?

The services we can provide may depend on the type of matter, the jurisdiction involved, and where our attorneys are authorized to practice. We’ll let you know if we cannot assist with a particular matter.

OwnAura Memberships

I have legal questions all the time. Is membership better for me?

It may be. If contracts, content protection, intellectual property, and business legal questions regularly come up in your business, ongoing membership may make more sense than purchasing individual services each time.

Explore OwnAura Memberships
What’s the difference between Aura Essential, Aura Pro, and Aura Studio?

Aura Essential provides foundational legal access and protection. Aura Pro adds greater monitoring, contract support, and priority attorney support. Aura Studio is designed for businesses that want the highest level of ongoing attorney involvement.

Compare Memberships
Can I still purchase individual services if I’m a member?

Yes. Membership does not necessarily replace every legal service you may need. Some work is included in your plan, while other services may be available separately or at member pricing.

Can I join if I already have trademarks, copyrights, contracts, or existing content?

Yes. Your membership can support assets you already have as well as new issues that arise, subject to your plan’s scope and limits.

Does membership mean I can ask a lawyer unlimited questions?

Your attorney access depends on the benefits and limits of your membership tier. Your membership details explain the type and frequency of access included.

Does membership include lawsuits or litigation?

No. Litigation, court appearances, administrative proceedings, and matters outside the stated scope of your membership are not included. Those matters may require a separate engagement if OwnAura is able to accept the matter.

Can I upgrade my membership as my business grows?

Yes. You can move to a higher membership tier when you need additional monitoring, contract support, or attorney involvement.

Is membership a replacement for hiring an attorney for a specific legal matter?

Not always. Membership covers the services and attorney access included in your plan. A particular dispute, transaction, filing, or other legal matter may require a separate engagement.

What happens if I need something that isn't included in my membership?

We’ll let you know when a request falls outside your membership benefits and whether OwnAura can assist through a separate service or engagement.

Still have a question?

Every situation is different. Talk it through with an IP attorney and leave with clear next steps.
